Napoles asks CA to stop her arrest - ABS CBN News

MANILA - The camp of businesswoman Janet Lim Napoles has filed a petition before the Court of Appeals to stop her arrest. Napoles and her brother, Reynald Lim, are wanted for serious illegal detention of her former employee Benhur Luy.

The petition for certiorari was filed by Napoles' lawyers before the appellate court. It urges the CA to immediately halt and stop the implementation of the arrest warrant issued by the Makati Regional Trial Court branch 150 against Napoles and Lim.

Lorna Kapunan, Napoles' lawyer, said she is also asking the CA to nullify the resolution of the Department of Justice that indicted Mrs. Napoles.

She said there was originally a dismissal of the same charges but a motion for reconsideration led to a reversal although NBI and Luy presented no new evidence in the serious illegal detention case.

Kapunan said the decision was "arbitrary and suspicious." She also noted that the Makati RTC did not rule on their motion to temporarily hold the issuance of an arrest warrant pending a ruling on their plea to determine probable cause.

She also denied they were tipped off about the issuance of the arrest warrant.

The lawyer said Mrs. Napoles signed the verification for the latest plea last Wednesday.
